Reasonable Accommodation Doctrine Disputes i n Colorado

The conflict between surface land owners and oil and gas operators prompted the enactment of Senate Bill 237, the Colorado Reasonable Accommodation Doctrine. This doctrine directs the operator to carry out operations to accommodate the surface owner by minimizing intrusion upon and damage to the surface of the land, including the use of alternative well locations or alternative operations. This is not to be construed as preventing an operator from entering and using the surface and also does not affect provisions of surface use agreements. It does direct surface owners to pay the drilling cost of directional wells to operators among other provisions.
